These Terms & Conditions (“Terms”) govern your access to and use of the GRPY website at www.grpygolf.com (the “Website”) and your purchase of products from us.
The Website is operated by GRPY GOLF (Registration No. 202503340833) (003804420-V) (“GRPY”, “we”, “us” or “our”).
By accessing or using the Website or placing an order with us, you agree to be bound by these Terms.
1. OUR PRODUCTS
1.1 We make reasonable efforts to ensure that the descriptions, photographs, colours, specifications and other information relating to our products displayed on the Website are accurate.
1.2 However, the actual colour or appearance of a product may vary slightly due to screen settings, photography, lighting and reasonable manufacturing variations.
1.3 All products are subject to availability. We reserve the right to modify or discontinue any product or design at any time.
2. ORDERS
2.1 By placing an order through the Website, you make an offer to purchase the products selected by you subject to these Terms.
2.2 Your order is accepted when we issue an order confirmation or dispatch the products to you, whichever occurs first.
2.3 We reserve the right to reject or cancel an order where reasonably necessary, including where:
(a) a product is unavailable;
(b) there is an obvious error in the price, description or other product information;
(c) payment cannot be authorised or processed;
(d) we reasonably suspect fraud, misuse or unauthorised activity; or
(e) we are unable to fulfil the order due to circumstances beyond our reasonable control.
2.4 If we cancel an order after payment has been received, we will refund the amount paid for the affected product(s).
3. PRICES AND PAYMENT
3.1 All prices displayed on the Website are in Malaysian Ringgit (RM), unless otherwise stated.
3.2 We may change our prices from time to time. Any change will not affect an order which has already been accepted by us.
3.3 Applicable delivery charges, taxes or other charges will be displayed at checkout before you confirm your order.
3.4 Payment must be made using one of the payment methods made available through the Website.
4. DELIVERY
4.1 We deliver to the locations specified on the Website.
4.2 Delivery timeframes displayed on the Website are estimates unless we expressly state otherwise.
Next-Day Delivery
4.3 Where GRPY advertises “Next-Day Delivery”, such service is available only for eligible orders delivered within Klang Valley, subject to applicable order cut-off times, delivery areas, public holidays, product availability and any other conditions specified on the Website.
4.4 Next-Day Delivery may not be available or guaranteed where delivery is affected by circumstances beyond our reasonable control, including courier delays, incorrect or incomplete delivery information provided by the customer, adverse weather, public holidays or delivery service disruptions.
Proof of Delivery
4.5 A product will be considered successfully delivered on the date on which:
(a) the relevant courier, delivery platform or tracking system records the order as successfully delivered; or
(b) GRPY otherwise has reasonable evidence confirming successful delivery.
4.6 You are responsible for providing complete and accurate delivery information when placing your order. GRPY will not be responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by you.
5. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
5.1 Inspection
Please inspect your products promptly after delivery.
If a product:
(a) is defective or damaged upon delivery;
(b) is materially different from the product ordered; or
(c) has been incorrectly supplied,
you should notify GRPY within five (5) calendar days from the date of successful delivery determined in accordance with Clause 4.5.
5.2 Making a Claim
To submit a claim, please contact us at [grpygolf@gmail.com] and provide:
(a) your order number;
(b) a description of the issue; and
(c) clear photographs and/or videos reasonably showing the defect, damage or incorrect product.
We may request further information reasonably required to assess your claim.
5.3 Do Not Continue Using a Defective Product
After discovering a defect, damage or that an incorrect product has been supplied, you should not install, alter, cut, modify or continue using the affected product, except to the extent reasonably necessary to identify the defect.
5.4 Remedies
Where we determine that a product is defective, damaged or incorrectly supplied, GRPY will provide an appropriate remedy in accordance with applicable law, which may include:
(a) replacement of the affected product;
(b) a refund of the amount paid for the affected product; or
(c) another remedy agreed between you and GRPY.
Where GRPY accepts a claim and requires the product to be returned, GRPY will bear the reasonable cost of returning the affected product.
5.5 Exclusions
Subject always to your rights under applicable law, GRPY will not be responsible for damage, deterioration or performance issues resulting from:
(a) normal wear and tear;
(b) incorrect or improper installation;
(c) excessive stretching or other damage caused during installation;
(d) the use of unsuitable tools, tapes, solvents or installation materials;
(e) misuse, neglect, abuse or use of the product other than for its intended purpose;
(f) modification or alteration of the product;
(g) failure to follow any installation, care or usage instructions provided by GRPY; or
(h) damage occurring after successful delivery which is unrelated to any defect existing when the product was supplied.
5.6 Installation
Golf grips should be installed correctly and in accordance with any installation instructions provided by GRPY or by a suitably experienced golf club fitter.
Where a customer chooses to install a product personally or through a third party, GRPY is not responsible for damage caused by incorrect installation.
5.7 Your Statutory Rights
The five (5) day notification period above is intended to enable GRPY to investigate and resolve issues promptly and does not exclude, restrict or modify any right or remedy available to a consumer which cannot lawfully be excluded or restricted under the Consumer Protection Act 1999 or any other applicable Malaysian law.
6. FREE MULLIGANS
Not feeling it? Take a mulligan.
In addition to your statutory rights, GRPY offers a voluntary “Free Mulligans” Money-Back Guarantee for eligible purchases subject to the following conditions.
6.1 You must notify us that you wish to return the product within five (5) calendar days from the date of successful delivery.
6.2 To qualify for a Free Mulligan return, the product must:
(a) be unused and uninstalled;
(b) not have been cut, stretched, altered, damaged or modified;
(c) be returned in its original condition and, where reasonably possible, its original packaging; and
(d) have been purchased directly from GRPY.
6.3 You must provide your order number or other reasonable proof of purchase.
6.4 Unless the product is defective, damaged or incorrectly supplied under Clause 5, the cost of returning the product to GRPY will be borne by you.
6.5 Once the returned product has been received and inspected by us and we confirm that it satisfies the requirements above, we will refund the purchase price paid for the eligible returned product through the original payment method.
6.6 Original delivery charges are non-refundable for a Free Mulligan return unless otherwise required by applicable law.
6.7 Free Mulligans do not apply to:
(a) products which have been installed or used;
(b) products which have been cut, stretched, altered, modified or damaged after delivery;
(c) personalised or customised products;
(d) products purchased from a third-party retailer or seller rather than directly from GRPY; or
(e) products expressly identified as final sale or non-returnable before purchase, to the extent permitted by applicable law.
6.8 Free Mulligans are additional to, and do not replace or limit, your statutory rights in respect of defective or non-conforming products.
7. REFUNDS
7.1 Approved refunds will ordinarily be made using the same payment method used for the original purchase, unless otherwise agreed.
7.2 Refund processing times may vary depending on your bank, card issuer or payment provider.
7.3 GRPY is not responsible for processing delays attributable solely to a bank, card issuer or payment provider after we have processed the refund.
8. PROMOTIONS AND DISCOUNT CODES
8.1 Promotions, bundles, discount codes and special offers may be subject to additional terms stated on the Website or communicated at the time of the promotion.
8.2 Unless otherwise stated, promotional codes:
(a) have no cash value;
(b) cannot be exchanged for cash;
(c) cannot be combined with another promotion or discount; and
(d) must be used within any applicable validity period.
8.3 We may modify, suspend or withdraw a promotion where reasonably necessary, provided that this will not affect an order which has already been accepted by us.
9. INTELLECTUAL PROPERTY
9.1 All intellectual property relating to GRPY and the Website, including the GRPY name, logo, branding, product names, product artwork and designs, graphics, illustrations, photographs, videos, text and other content, is owned by or licensed to GRPY and is protected by applicable intellectual property laws.
9.2 Except for personal and non-commercial use of the Website, you may not copy, reproduce, modify, distribute, publish, commercially exploit or otherwise use any GRPY content without our prior written consent.
9.3 Nothing in these Terms transfers any intellectual property rights belonging to GRPY or its licensors to you.
10. WEBSITE USE
You must not:
(a) use the Website for any unlawful or fraudulent purpose;
(b) interfere with the operation or security of the Website;
(c) attempt to gain unauthorised access to the Website or any related systems;
(d) introduce viruses, malicious software or other harmful code;
(e) scrape, reproduce or commercially exploit Website content without our consent; or
(f) use the Website in any manner which may damage GRPY or interfere with another person’s use of the Website.
11. LIMITATION OF LIABILITY
11.1 Nothing in these Terms excludes or limits any liability or consumer right which cannot lawfully be excluded or limited.
11.2 Subject to Clause 11.1 and to the fullest extent permitted by applicable law, GRPY will not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of the Website or purchase or use of our products.
11.3 Subject to Clause 11.1 and to the fullest extent permitted by applicable law, GRPY’s aggregate liability arising out of or relating to an order will not exceed the amount paid by you for the product giving rise to the claim.
12. EVENTS BEYOND OUR CONTROL
12.1 GRPY will not be responsible for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, severe weather, transportation or courier disruption, governmental action, telecommunications or system failures, strikes or other events outside our reasonable control.
12.2 Nothing in this Clause affects any rights which cannot lawfully be excluded.
13. PERSONAL DATA AND PRIVACY
13.1 We may collect, use, store and otherwise process personal data in connection with your use of the Website, your orders and our relationship with you.
13.2 Personal data will be handled in accordance with our Privacy Notice / Policy and applicable Malaysian data protection laws.
14. THIRD-PARTY SERVICES
14.1 The Website may use or contain links to third-party services, including payment providers, delivery providers and social media platforms.
14.2 GRPY is not responsible for the availability, content or independent acts or omissions of third-party services, except to the extent responsibility cannot lawfully be excluded.
15. CHANGES TO THESE TERMS
15.1 We may update these Terms from time to time by publishing the revised Terms on the Website.
15.2 The Terms applicable to your purchase will be those in effect at the time your order is placed.
16. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.
17. GOVERNING LAW AND DISPUTES
17.1 These Terms are governed by the laws of Malaysia.
17.2 Subject to any rights available to consumers under applicable law, any dispute arising out of or in connection with these Terms, the Website or your purchase of GRPY products will be subject to the jurisdiction of the courts of Malaysia.
17.3 Nothing in these Terms prevents a consumer from exercising any right to bring an eligible claim before the Tribunal for Consumer Claims Malaysia (TTPM) or any other competent authority.
